Unlike patent protection which requires the inventor to disclose the specifics of his or her invention in exchange for a period of exclusive use of the invention, trade secrets can last forever. A trade secret can be any information, in any form, that provides a business a competitive advantage or provides it some value. The trade secret must obviously be “secret” to the outside world. We often advise clients on how to best protect their trade secret information, including the preparation of non-disclosure agreements for employees and contractors. We have also been involved in many cases of alleged trade secret misappropriation by former employees on both the defense and plaintiff sides of the docket.
